BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:05am.

Chairman Blando did the swearing in of new Board member, Dr. Cynthia Conrad, representing Department of Mental Health and Addiction Services.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, one appellant failed to appear. The State Issuing Authority and nine Local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. Cynthia Conrad, Carolyn Futtner Esq., Gudrun Johnson, Mr. M. Peter Kuck, and Chief Carl Rosensweig.

Board Members Absent: Anthony Iaconis, Esq.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Ten cases were heard in the following order:

1) Case No. 18-331-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

2) Case No. 19-008-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Stephen Paulson represented the Local Issuing Authority, Chief Ed Lennon, East Haven Police Department.

Withdrawal: The appellant withdrew his case.

3) Case No. 19-276-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Sgt. Brian Santa represented the Local Issuing Authority, First Selectman Lori Spielman, Town of Ellington.

Withdrawal: The appellant withdrew his case.

4) Case No. 19-337-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Leon Krolikowski represented the Local Issuing Authority, Chief Leon Krolikowski, New Canaan Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

5) Case No. 18-585-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. City Counsel John Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and asked New Britain to issue the permit.

6) Case No. 19-301-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola was present for the Local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

7) Case No. 19-314-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Matthew Solak was present for the Local Issuing Authority, Chief Roberto Rosado, Willimantic Police Department.

Continuance: Case was continued due to a language barrier. Office Manager, Nancy Lotas was instructed to find interpreter for a future date.

8) Case No. 19-241-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. City Counsel John Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

9) Case No. 19-268-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. City Counsel John Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and asked New Britain to issue the permit.

10) Case No. 19-294-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Ken Lyman appeared for the local Issuing Authority, Chief Tim Shaw, Easton Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from June 6, 2019, seconded by Board member Kuck, motion carried. Ms. Johnson and Dr. Conrad abstained.

New Business:

Discussed adding a November 7, 2019 hearing

Adjournment: Board member Kuck made a motion to adjourn. Seconded by Co. Overturf, motion carried. Meeting ended at 1:40pm.
