BOARD OF FIREARMS PERMIT EXAMINERS
Thursday November 29, 2012, 12:00pm at the
Community Room, Wethersfield Police Department
Call to Order
Attorney Craig Fishbein called the meeting to order at 12:05pm.
Attorney Fishbein read the Introductory Statement.
Chairman Corradino called the roll call 13 appellants were present and 2 appellant were absent.
The State Issuing Authority was present and 6 local Issuing Authorities were present.
Board Members Present: Attorney Joseph T. Corradino, Chairman, Atty. Craig Fishbein, Atty. Jay Greer, Mr. M. Peter Kuck, and Mr. Kenneth Tramadeo.
Board Members delayed: Col. Kyle Overturf arrived at 1:20pm
Board Members Absent: Chief T. William Knapp, (Ret.)
Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.
Hearings
1) Case No. 12-336-D, Christopher F. Mierez, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Brien Smith, Records Dept. represented the local Issuing Authority Chief James Kenney, Vernon Police Department.
Withdrawal: The appellant withdrew his appeal.
2) Case No. 12-333-D, Jason Boucher, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative of the local Issuing Authority Chief Edward Stephens, Wolcott Police Department was present.
Decision: By a unanimous decision for the local Issuing Authority, Chief Stephens, Wolcott Police Department, by default due to the appellants failure to appear.
3) Case No. 12-325-D, Paul Daigneau, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local Issuing Authority Chief Carl Sferrazza, Enfield Police Department was present.
Withdrawal: The appellant withdrew his appeal due to a disqualifier, Assault 3.
4) Case No. 12-342-R, Howard Alston, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Motion: Corradino made a motion to continue the case for the decision to March 14, 2012, Fishbein seconded the motion, motion carried.
5) Case No. 12-277-D, Jason Lacen-Romero, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Kevin Burns represented of the local Issuing Authority Chief Paul Melanson, Farmington Police Department with two witnesses.
Decision: By a unanimous decision, the Board voted to overturn the decision of denial from the local Issuing Authority, Chief Paul Melanson, Farmington Police Department, and voted for Mr. Lacen-Romero to be issued a temporary pistol permit.
6) Case No. 12-198-D, Daniel Torres, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. A representative of the local Issuing Authority Chief Michael Gugliotti, Waterbury Police Department was present.
Decision: By a unanimous decision, the Board vote for Mr. Torres, by default, due to the local Issuing Authority’s failure to provide a written statement as to why the appellant was denied, at least 10 days prior to the hearing in accordance with C.G.S.29-32b(c).
7) Case No. 12-335-D, James Tyszkiewicz, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. DeSanko represented of the local Issuing Authority Chief Shawn Boyne, New Milford Police Department.
Decision: By a unanimous decision, the Board voted to overturn the decision of denial from the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department, and voted for Mr. Tyszkiewicz to be issued a temporary pistol permit.
8) Case No. 12-310-R, Christopher Sharp, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his appeal.
9) Case No. 12-290-R, Jonathan Keith, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Decision: By a unanimous decision, the Board voted to uphold the decision to revoke from the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.
10) Case No. 12-238-R, Jocelyn Johnson, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew her appeal.
11) Case No.12-286-R, Adam Pratt, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Mark Quellette represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his appeal.
12) Case No. 12-273-R, Elbert Morgan, Jr., involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his appeal due to an active protective order.
13) Case No. 12-292-R, Samuel Arias, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his appeal.
14) Case No. 12-294-R, Paul J. Parrow, III, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Robert J.T. Britt represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Agreement: Prior to the hearing the appellant and the State Issuing Authority came to a stipulated agreement.
15) Case No. 12-293-R, Mary Frano, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and for Ms. Frano to be reissued her pistol permit.
