BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Secretary T. William Knapp called the meeting to order at 12 noon.

  

Secretary Knapp read the Introductory Statement.

Secretary Knapp called the roll call 11 appellants were present, 10 local Issuing Authorities were present and I absent.

Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, (Ret.), Board Secretary, Mr. Jay Greer, Mr. M. Peter Kuck, and Mr. Kenneth Tramadeo

Board Members Absent: Col. Kyle Overturf

Board Member Kuck made a motion to recess until the Chairman arrived, Greer seconded the motion, motion carried.

Chairman Corradino arrived 12:40pm and administered the oath to all witnesses.

1) Case No. 12-419-D, Erik B. Schmaling, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Joseph Destefano was present to represent the local Issuing Authority, Chief Keith Mello, Milford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the denial, of the local Issuing Authority, Chief Keith Mello, Milford Police Department, and voted for Mr. Schmaling to be issued his temporary pistol permit.

2) Case No. 12-220-D, Kashif Iqbal, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Joseph Destefano was present to represent the local Issuing Authority, Chief Keith Mello, Milford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the denial, of the local Issuing Authority, Chief Keith Mello, Milford Police Department, and voted for Mr. Iqbal to be issued his temporary pistol permit.

3) Case No. 12-190-D, Raymond Williams, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Heather Desmond appeared for the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Motion: Knapp made a motion in favor of the local Issuing Authority, Chief William McKenna, Middletown Police Department, due to the appellant’s felony conviction which disqualifies the Mr. Williams from appealing.

4) Case No. 12-186-D, Nicholas Anselmo, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Records Supervisor Louis  Palshaw represented the local Issuing Authority, Chief James L. Kenney, Vernon Police Department with one witness.

Decision: By a unanimous decision, the Board voted to overturn the denial, of the local Issuing Authority, Chief James L. Kenney, Vernon Police Department, and voted for Mr. Anselmo to be issued his temporary pistol permit.

5) Case No. 12-197-D, LaKinya Pace, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. A representative from the local Issuing Authority, Chief Thomas Kiely, Trumbull Police Department, failed to appear.

Motion: Knapp made a motion to find for the appellant by default, due to the local Issuing Authority’s failure to appear.  Kuck seconded the motion, motion carried. The Board ordered  Ms. Pace to be issued an eligibility certificate.

6) Case No. 12-299-D, Stuart S. Cutler, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Corp. Patrill represented the local Issuing Authority, Chief Todd Lawrie, Clinton Police Department.

Decision: By a unanimous decision, the Board voted to overturn the denial, by default, due to the local Issuing Authority’s failure to provide the written statement as to why the appellant was denied, at least 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for Mr. Cutler to be issued a temporary pistol permit.

7) Case No. 12-193-D, Mario Gaston, Jr. involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Liam Pesce represented the local Issuing Authority, Chief James C. Rovella, Hartford Police Department.

Withdrawal: The appellant withdrew his appeal.

8A)  Appellant. DeBlasi Motioned for Judgment by default: Motion Denied.

8B) Case No. 12-253-D, David B. DeBlasi involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Marc Mikulski

represented the local Issuing Authority, Chief Douglas L. Dortenzio, Wallingford Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the denial of the local Issuing Authority, Chief Douglas L. Dortenzio, Wallingford Police Department, at this time.

9) Case No. 12-247-D, Robert L. Bain involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Kraign Gray represented the local Issuing Authority, Chief James J. Heavey, Greenwich Police Department.

Decision: By a majority, the Board voted to overturn the denial of the local Issuing Authority, Chief James J. Heavey, Greenwich Police Department, and voted for Mr. Bain to be issued a temporary pistol permit. Board member Greer voted for the local Issuing Authority. Board members, Corradino, Knapp, Kuck and Tramadeo voted for the appellant.

10) Case No. 12-266-D, Carolyn A. Collins involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative was present for the local Issuing Authority, Chief Michael Crowley, Groton Police Department.

Decision: By a unanimous decision the Board voted for the local Issuing Authority, Chief Michael Crowley, Groton Police Department, by default, due to the appellant’s failure to appear.

11) Case No. 12-229-D, Devon G. Wilson, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Bryon Smith represented the local Issuing Authority, Chief Edward DeMarco, East Windsor Police Department.

Decision: By a unanimous decision, the Board overturned the denial, by default, due to the local Issuing Authority’s failure to provide the written statement as to why the appellant was denied, at least 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for Mr. Wilson to be issued a temporary pistol permit.

Adjournment: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried.
