Call to Order

Chairman Joseph T. Corradino, Esq. called the meeting to order at 12:00pm.

  

Chairman Corradino called the roll call, 12 appellants were present. The State Issuing Authority and 5 local Issuing Authorities were present.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

Board Members Present: Chairman Joseph T. Corradino, Esq., Secretary T. William Knapp, Mr. Arthur Carr, Mr. Jay Greer, Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo. 

Board Members Absent: Mr. Peter Kuck,

Cases scheduled for hearings:

1)Case 11-34-R, Esquiel Zambrano, involving the revocation of his pistol permit to carry pistols and revolvers. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: Board Members were informed by staff that Mr. Zambrano’s attorney, Gregory J. Sachs, Esq., had withdrawn the appeal prior to the hearing.

2) Case No. 11-274-D, Jonathan Duffy, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Detective John Fiore represented the local Issuing Authority, Chief J. Darren Stewart, Stonington Police Department.  

Decision: By a majority, the Board voted to overturn the decision of the local Issuing Authority, Chief Robert Scannell, Winchester Police Department, and for Mr. Duffy to be issued a temporary pistol permit. Corradino and Overturf voted for the local Issuing Authority. Carr, Greer, Knapp and Tramadeo voted for the appellant.

3) Case No. 11-166-R, Jeffrey Brex, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Brex’s pistol permit.

4) Case No. 11-125-R, Marland Scott, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Scott’s pistol permit.

5) Case No. 11-242-R, Michael Petersen, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant, Mr. Petersen, withdrew his appeal.

6) Case No. 11-97-R, Carlos Diaz, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Gary P. Cahiil represented the appellant. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant, Mr. Diaz, withdrew his appeal.

7) Case No. 11-250-R, Joseph Mahoney, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted, by default, to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Mahoney’s pistol permit, for failure to appear.

8) Case No. 11-79-R, Luis Rodriguez, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Major Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for Mr. Rodriguez to be reinstated his pistol permit. Corradino and Greer voted for the State Issuing Authority, at this time. Carr, Knapp, Overturf and Tramadeo voted for the appellant.

9) Case No. 11-279-D, Richard Valuk, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Douglas A. Hall represented the appellant. Officer John Burns represented the local Issuing Authority, Chief Paul Fitzgerald, Berlin Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Paul Fitzgerald, Berlin Police Department, and for Mr. Valuk to be issued a temporary pistol permit.

10) Case No. 11-280-C, Melissa Flynn, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Chief Neil Dryfe, Cheshire Police Department represented as the local Issuing Authority.

Decision: By a majority, the Board voted to uphold the decision of the local Issuing Authority, Chief Neil Dryfe, Cheshire Police Department, the denial of a temporary pistol permit. Tramadeo voted for the appellant. Carr, Corradino, Greer, Knapp and Overturf voted for the local Issuing Authority.

11) Case No. 11-278-D, Gaynel Miller, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Officer Hoite represented the local Issuing Authority, Chief Dean Esserman, New Haven Police Department represented as the local Issuing Authority.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department, and for Ms. Miller to be issued a temporary pistol permit.

12) Case No. 11-164-D, Ralph Iannuzzi, Jr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer William Roy represented the local Issuing Authority, Chief John Drumm, Madison Police Department.

Withdrawal: The appellant and the local Issuing Authority agreed that if the appellant withdrew his appeal, the town would issue a temporary pistol permit. The Chairman stated should the appellant not receive a pistol permit by Tuesday, Jan. 31, 2012, the appellant’s case would be added to the next scheduled Board meeting.

Secretary’s Report:

1) Approval of the December 28, 2011 Minutes. Tramadeo made a motion to accept the minutes as written, Knapp seconded the motion, motion carried.

Adjournment: Tramadeo made a motion to adjourn, Overturf seconded the motion, motion carried.
