Allegation(s)

  • Failure to implement the IEP (34 CFR §300.17(d))
  • The Parent’s allegation was regarding: (a) instruction from a fluency specialist; (b) specialized math instruction; (c) accommodations and modifications; (d) Extended School Year (ESY)
  • Failure to send the parent a copy of the IEP within five days after a PPT meeting (Regulation of Connecticut State Agencies (“RCSA”) § 10-76d-13(a)(6))

Investigation Conclusion(s)

  • The LEA failed to provide the instruction from a fluency specialist in accordance with the IEP.
  • The LEA failed to provide specialized math instruction in accordance with the IEP .
  • ESY services were provided (no regulatory violation).
  • The student’s December 16, 2022 IEP was sent within five days after the PPT (no violation)
  • The student’s June 2, 2023, IEP was not provided to the parent within five days after the PPT the LEA is in violation of RSCA § 10-76d-13(a)(6).
  • All of the PPT membership requirements were satisfied.

Corrective Action

  • On or before September 30, 2023, the District, in collaboration with the Parents, shall develop a compensatory services plan to provide the Student with 20 hours of missed service with a fluency specialist.
    • Such plan shall include a provision that those services must be delivered in full no later than June 30, 2024.
    • Given the burden that this may place on the Student, the Bureau allows that the District and Parent may choose to develop, in lieu of the 20 hours of service, an alternate, but mutually beneficial, compensatory services plan, that takes into consideration the tolerance levels of the Student.
    • Any compensatory education plan must be submitted to the state no later than September 30, 2023.
    • Upon delivery of the full measure of compensatory services to the Student, the District must submit an attestation to the state as verification that corrective action #1 has been completed.
  • On or before September 30, 2023, the District, in collaboration with the Parents, shall develop a compensatory services plan to provide the Student with 5 hours and 50 minutes of missed math services.
    • Such plan shall include a provision that those services must be delivered in full no later than June 30, 2024.
    • Given the burden that this may place on the Student, the Bureau allows that the District and Parent may choose to develop, in lieu of the 5 hours and 50 minutes of service, an alternate, but mutually beneficial, compensatory services plan, that takes into consideration the tolerance levels of the Student.
    • Any compensatory education plan must be submitted to the state no later than September 30, 2023.
    • Upon delivery of the full measure of compensatory services to the Student, the District must submit an attestation to the state as verification that corrective action #2 has been completed.
  • The parent has been provided a copy of the June 2, 2023, IEP, there are no further corrective actions.
