Chapter 11: Discontinuation of Special Education and Related Services
The District will provide special education and related services in accordance with a student’s IEP, unless the student’s eligibility has been terminated in accordance with federal and state special education law. A student’s eligibility under the IDEA is terminated when the student: (1) no longer meets eligibility criteria, (2) graduates from high school with a regular high school diploma, or (3) reaches the maximum age of eligibility. In Connecticut, students remain eligible to receive special education and related services through the end of the school year during which the student turns age 22, or until the student graduates with a regular high school diploma, whichever occurs first.
Student No Longer Meets Eligibility Criteria
If the PPT suspects that a student is no longer a student with a disability, the District will conduct a comprehensive reevaluation of the student.73 If after reviewing the evaluation, the PPT determines that the student is no longer eligible for special education, the District will provide the parent/adult student with PWN before discontinuing special education services.
Graduation from High School with a Regular Diploma
The District’s obligation to provide special education and related services ends when the student graduates from high school with a regular diploma. This is considered a change of placement.
Prior to graduation and the discontinuation of services, the District will provide the parent/adult student with the following:
- PWN; and
- Summary of Performance (SOP).
Student Exceeds Age of Eligibility
Pursuant to state law, the District’s obligation to provide special education and related services extends through June 30th of the school year during which the student turns age 22. The school year is defined as July 1st through June 30th of the following calendar year.
Prior to exceeding the age of eligibility and the discontinuation of services, the District shall provide the parent/adult student with a SOP.
Participation in Graduation Exercises and Related Activities
Each student with a disability shall be entitled to participate in the general education high school graduation exercises and related activities of the board of education in the event such student will not be graduating with a general education high school diploma.74 The student, the student’s parents, and the PPT shall determine the student’s high school graduating class for purposes of participation in the high school graduation exercises and related activities. A student with a disability is entitled to participate in high school graduation exercises and related activities while such student is enrolled in high school.
