December 18, 2013

     The above-captioned matter was scheduled to be heard as a contested case on November 6, 2013, at 9:30 a.m., at which time the respondents were present but the complainant failed to appear.  The respondents moved for dismissal of the complaint.
     The complainant subsequently withdrew his complaint by letter dated November 11, 2013.  The Freedom of Information Commission takes administrative notice of such letter.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  Based on the withdrawal of the complaint, the complaint is dismissed.
