     For purposes of the hearing, the above-captioned matter was consolidated for hearing with Docket #FIC 2012-670, James Torlai v. Commissioner, State of Connecticut, Department of Emergency Services and Public Protection; and State of Connecticut, Department of Emergency Services and Public Protection (the “consolidated case”).  Both matters were scheduled to be heard as contested cases on July 3, 2013, at which time the complainant appeared, but the respondents failed to appear.  The Hearing Officer continued the hearing on the matters to August 30, 2013.  Prior to the August 30, 2013 contested case hearing, the complainant withdrew the complaint in the consolidated matter.
     The Hearing Officer continued the August 30, 2013 contested case hearing in the above-captioned matter to September 26, 2013.  By email dated September 25, 2013, the complainant informed the Commission that the respondents provided additional records related to his October 11, 2012 request for records that resolved the underlying issues to the complainant's satisfaction prior to the continued hearing in the above-captioned case.  The complainant therefore wished to withdraw the complaint in the above-captioned matter.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  Based on the withdrawal of the complaint, the complaint is dismissed.
     2.  The Commission commends the parties on having reached a settlement of this matter without adjudication.
