     The above-captioned matter was scheduled to be heard as a contested case on July 3, 2013, at which time the complainant appeared, but the respondents failed to appear.  The Hearing Officer continued the hearing to August 30, 2013.  By email dated August 9, 2013, the complainant informed the Commission that the respondents provided additional records related to his November 18, 2012 request for records that resolved the underlying issues to the complainant's satisfaction prior to the continued hearing in the above-captioned matter.  The complainant therefore wished to withdraw the complaint.  For purposes of the hearing, the above captioned matter was consolidated with Docket #FIC 2012-684, James Torlai v. Commissioner, State of Connecticut, Department of Emergency Services and Public Protection; and State of Connecticut, Department of Emergency Services and Public Protection.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  Based on the withdrawal of the complaint, the complaint is dismissed.
     2.  The Commission commends the parties on having reached a settlement of this matter without adjudication.
