The above-captioned matter was heard as a contested case on April 5, 2013, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

     Thereafter, on July 30, 2013, a hearing officer’s report issued.  The hearing officer found no violation of the Freedom of Information Act and recommended that the complaint be dismissed. 

     By email dated August 5, 2013, the complainant informed the Commission that he was withdrawing the complaint.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

     1.  The complaint is dismissed.
