     Respondents
April 10, 2013

     The above-captioned matter was scheduled to be heard as a contested case on March 27, 2013, at 2:00 p.m., at which time the respondents were present but the complainant failed to appear.  The respondents moved for dismissal of the complaint and for the imposition of sanctions against the complainant.  The Commission declines to impose sanctions.
     Following the hearing in this matter, the complainant withdrew his complaint by letter dated April 1, 2013.  The Freedom of Information Commission takes administrative notice of such letter.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  Based on the withdrawal of the complaint, the complaint is hereby dismissed.
