The above-captioned matter was scheduled to be heard as a contested case on April 22, 2013, at 11:00 a.m., at which time the respondents were present but the complainant did not appear.  The respondents moved for dismissal of the complaint. 

     Following the hearing in this matter, the complainant withdrew his complaint by fax sent at 11:38 a.m. on April 22, 2013.   The Freedom of Information Commission takes administrative notice of such letter.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1. The complaint is dismissed.
