November 14, 2012

     The above-captioned matter was heard as contested case on August 13, 2012, at which time the complainant and the respondents appeared and presented testimony and argument on the complaint. The parties also expressed their desire to negotiate a resolution of the case following the hearing.
     By letter dated October 8, 2012, the complainant reported to the Commission that the matter had been “amicably resolved” and requesting that the case be withdrawn.
     The following orders by the Commission are hereby recommended on the basis of the record:
     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
     2.  The Commission commends the parties on having agreed to a settlement without full adjudication.
