     The above-captioned matter was heard as a contested case on October 2, 2012, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  The complainant’s counsel represented on the record that the complainant had made a request for copies of four categories of records, and that the respondent had satisfied the request with regard to the first, second and fourth categories of records.  Upon examination of the respondent’s witness by the complainant, testimony was elicited that the respondent does not maintain any records responsive to the complainant’s fourth category of records.  Upon receiving this testimony, the complainant withdrew her complaint. 
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  The case is hereby dismissed.
