     The above-captioned matter was scheduled to be heard as a contested case on September 20, 2012, at which time the respondents appeared.  However, the complainant, who is incarcerated and must appear via teleconference, could not be persuaded by staff of the respondent department to come to the telephone and participate in the hearing.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  The complaint is hereby dismissed with prejudice.
