The above-captioned matter was scheduled for hearing as a contested case on July 16, 2012, at which time the complainant failed to appear. The order to show cause was mailed to the complainant’s last known address at the Corrigan-Radgowski Correctional Institution. The respondents represented that the complainant had been released from incarceration during June 2012 and that the contact information he left was not valid.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1. The complaint is hereby dismissed for failure to prosecute.

     Approved by Order of the Freedom of Information Commission at its regular meeting of August 8, 2012.
