     The above-captioned matter was consolidated for hearing with Docket #FIC 2011-411; also captioned Loren Casertano v. Chief, Police Department, City of Shelton, and Police Department, City of Shelton. It was heard as a contested case on March 26, 2012, at which time the complainant and the respondents appeared and presented testimony and argument on the complaint. Following this process, the parties agreed to a procedure to settle the case.
     On March 29, 2012, the complainant filed a motion to reopen the hearing, which was granted by the hearing officer on April 2, 2012. A second hearing was held on May 4, 2012, at which the parties affirmed the settlement and the written withdrawal of this matter on file. The parties reached certain agreements concerning additional records requests, which agreements are not part of this case.
     The Commission recommends the following order on the basis of the record:
     1. Based on the withdrawal of the complaint, the case is hereby dismissed.
