The above-captioned matter was scheduled to be heard as a contested case on December 12, 2011, at which time the complainant and the respondents appeared.

The parties agreed to conduct an off the record settlement conference, without the presence of the hearing officer.  After the hearing officer was called back into the hearing room, the complainant stated on the record that he wished to withdraw his complaint, based on a letter provided to him from the respondents during the settlement conference.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the complaint is dismissed.
Approved by Order of the Freedom of Information Commission at its regular meeting of March 28, 2012.
