The above captioned matter was heard as a contested case on June 21, 1978 at which time the complainant and respondents appeared and presented evidence and argument on the complaint.
After consideration of the entire record the following facts are found:
1. The respondents are public agencies within the meaning of §l-18a(a), G.S.
2. By letter filed with this commission on May 18, 1978, the complainant alleged that the respondent board violated the minutes and votes requirements of §1-21, G.S. with respect to three separate meetings which were held on April 26, 27, and 28, 1978.
3. The gatherings in question were work sessions which were held by the respondent board in order to modify the proposed town budget.
4. No minutes or records of votes of the work sessions were recorded and filed.
5. At least one vote was taken during the work sessions.
6. It is found that the work sessions were meetings within the meaning of §l-18a(b), G.S.
7. It is concluded that the respondent board failed to comply with the requirements of §l-21, G.S. that votes on issues before a public agency be recorded within 48 hours and minutes be available within one week.
The following order of the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
1. Henceforth the respondent board shall comply with the requirements of §1-21, G.S.
