In the Matter of a Complaint by

         The above captioned matter was heard as a contested case on September 19, 1978, at which time the complainant appeared with a stipulation of facts co-signed by the respondents.  The complainant further presented testimony and argument on the complaint.
         After consideration of the entire record, the following facts are found:
         1. The respondents are public agencies as defined by §l-18a(a), G.S.
         2. By letter of complaint filed with the Commission on July 7, 1978, the complainant alleged that the respondent board held a meeting on June 19, 1978 without complying with the notice and minutes requirements of the Freedom of Information Act .
         3. A quorum of the respondent board held a meeting on June 19, 1978.
         4. It is found that no public notice to such meeting was given as required by §1-21, G.S.
         5. It is further found that minutes of such meeting were never filed, in violation of §1-21, G.S.
         The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
         1. The respondent board shall forthwith prepare and file minutes of its June 19, 1978 meeting.
         2. Henceforth, the respondent board shall post notice to all of its special meetings in the office of the clerk of the respondent city and town, as required by §1-21, G.S.  In this regard, such notice shall be posted not less than twenty-four hours prior to the time of the meeting and shall specify the time and place of the special meeting and the business to be transacted therein.
         3. Henceforth, the minutes of all meetings of the respondent board shall be available for public inspection within seven days of the session to which they refer, as further required by §l-21, G.S.
