The above captioned matter was heard as a contested case on June 26, 1978, at which time the complainant and the respondents appeared, stipulated to certain facts, and presented testimony, exhibits and argument on the complaint.

     After consideration of the entire record, the following facts are found:

     1. The respondents are public agencies as defined by §1-18a(a), G.S.

     2. By letter dated April 19, 1978, the complainant requested from the respondent president a copy of a document entitled "Biographical Description of the Education and Experience of the Professional Staff of NCCC (1976)."

     3. By complaint letter filed with the Commission on May 9, 1978, the complainant alleged that the respondent president had denied such request, in violation of the Freedom of Information Act.

     4. The respondents have not kept in their files a copy of the requested record.

     The following order of the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:

     1. The complaint is hereby dismissed.
