Department of Public Works of the City and Town
of Bridgeport,
     Respondents

     The above captioned matter was heard as a contested case on June 19, 1978, at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.
     After consideration of the entire record, the following facts are found:
     1.  The respondents are public agencies as defined by §1-18a(a), G.S.
     2.  By letter dated April 17, 1978, the complainant requested from the respondent department "... the actual dollar cost for the use of city equipment and city personnel ... pertaining to the ferry boat called 'Miss New York ’”.
     3.  The complainant treated the respondent director's failure to comply with such request within four business days as a denial. From such denial, the complainant filed the present appeal with the Commission on April 27, 1978, by letter dated April 26, 1978.
     4.  The complainant is a person within the meaning of §1-18a(c), G.S.
     5.  The night before the hearing herein, the respondents gave to the complainant a list of all expenditures incurred by the city of Bridgeport for equipment, labor and materials pertaining to
the ferryboat.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
     1.  The complaint is hereby dismissed.
