The above captioned matter was heard as a contested case on May 15, 1978, at which time the  complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.

     After consideration of the entire record, the following facts are found:

     1.  The respondents are public agencies as defined by §1-18a(a), G.S.

     2.  By letter dated March 25, 1978, the complainant requested from the respondent office a copy of a certain contract by the Park City Housing and Development Corporation and the Century Builders Company.

     3.  By letter dated March 29, 1978, the respondent office  notified the complainant where, outside of its  office, such documents are located.

     4.  From such reply, the complainant filed the present complaint with this Commission dated April 3, 1978 and filed herewith on April 3, 1978.

     5.  The requested document is not in the possession or custody of the  respondent office.
On the basis of the record concerning the above-captioned complaint I hereby recommend the following order by the Commission:

     1.  The complaint is hereby dismissed.
