The above captioned matter was scheduled for hearing on November 17, 1978, at which time both the complainant and the respondents appeared and presented some evidence on the complaint. The hearing on the aforesaid matter was not completed, however, because the respondent superintendent declined to answer certain questions.

       The Commission thereafter sought an order compelling testimony from the Superior Court which was denied and then appealed by the Commission to the Supreme Court.   While that appeal was pending, the complainant withdrew the above entitled complaint.

      The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:

       1.  The complaint is hereby dismissed.
