In this consolidated appeal, the superior court reversed and remanded three decisions of the Commission that concluded that the respondent board of education adequately described the business to be transacted in executive session on its meeting agendas.
The board of education claimed that a legal memorandum was discussed in executive session and that if the subject matter of the memorandum was revealed on the agenda, it would disclose confidential communications discussed with its attorney pursuant to Conn. Gen. Stat. §1-210(b)(10). However, the court determined that there was no evidence in the record to support the Commission’s finding that disclosure of the subject matter of the memorandum would reveal its contents and that therefore such finding was unreasonable.
