     The above-captioned matter was heard as a contested case on August 27, 2015, at which time the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  At the request of the respondents, the executive director of the respondent Board at the time of the hearing in this matter was substituted for the executive director at the time of the complainants’ request.
     Following the hearing in this matter, the complainant withdrew his complaint by email sent October 22, 2015.  The Freedom of Information Commission takes administrative notice of such letter.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1.  Based on the withdrawal of the complaint, the complaint is dismissed.
Approved by Order of the Freedom of Information Commission at its regular meeting of November 18, 2015.
