The above-captioned matter was scheduled to be heard as a contested case on June 29, 2015 at 2:30 P.M. at which time Attorney Mark T. Anastasi, Corporation Counsel for the City of Bridgeport, appeared on behalf of the respondents, but the complainant did not appear to prosecute the case.

     The hearing officer notes that Attorney Anastasi represented that, prior to the scheduled hearing, he had spent considerable time reviewing the administrative record, speaking to the respondents, and preparing the affidavit of Margo Litz, a paralegal in his office.  Attorney Anastasi submitted the affidavit into evidence.  In the affidavit, Ms. Litz avers that she searched for, assembled and provided the requested records to the complainant in this case free of charge.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  The complaint is hereby dismissed.

     2.  The complainant is admonished for his failure to appear at the hearing in this matter, which failure resulted in a waste of scarce state and local resources.
