The above-captioned matter was scheduled to be heard as a contested case on July 16, 2015 at 1:00 P.M, at which time Attorney John Wayne Fox, counsel for the Town of Greenwich, appeared on behalf of the town, but the complainant did not appear to prosecute the case.

     The hearing officer notes that Attorney Fox represented that, prior to the scheduled hearing, he had spent time reviewing the administrative record, and researching matters that he thought would be relevant for the day’s hearing.  Counsel further represented that, in order to arrive to the Commission on time, he had left Greenwich over an hour and a half prior to the time the contested case hearing was scheduled to begin.  Counsel anticipated that it would take them just as long to return to Greenwich. 

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  The complaint is hereby dismissed.

     2.  The complainant is admonished for her failure to appear at the hearing in this matter, which failure resulted in a waste of scarce state and local resources.
