The above-captioned matter was heard as a contested case on December 3, 2014, at which time the complainant and the respondents appeared and presented testimony and argument on the complaint. Because the parties expressed a desire to reconcile their differences, the hearing officer left the room and asked the ombudsman to discuss the case with the parties outside of formal hearing.

     By letter filed with the Commission on February 26, 2015, the complainant stated that he wished to withdraw his complaint.

    The following orders by the Commission are hereby recommended on the basis of the record:

     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.

     2.  The Commission commends both parties on having negotiated a settlement following the hearing and without full adjudication.
