The above-captioned matter was heard as a contested case on November 15, 2013, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  For purposes of hearing, this matter was consolidated with the Docket #FIC 2013-340; Arthur Kureczka v. Jeffrey Bridges, Town Manager, Town of Wethersfield; and Town of Wethersfield.

     At the start of the contested case hearing, the complainant informed the Commission that, while this was a two-part request for records, the respondents had provided him with the records responsive to part one of his request.  As such, the complainant informed the Commission that the first part of his request was no longer at issue.

     Thereafter, after testimony was received and documents were taken into evidence, the complainant informed the hearing officer that he desired to withdraw part two of his request.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  Based on the complainant’s withdrawal, all matters in this case are considered settled and the case is hereby dismissed.
