The above-captioned matter was heard as a contested case on December 12, 2013, at which time the complainant appeared, and presented testimony, exhibits and argument on the complaint.  The respondents did not appear at the contested case hearing.

     At the conclusion of the complainant’s presentation, the hearing was continued to January 23, 2014, so that the hearing officer could hear from the respondents before issuing a written recommendation in this matter.

     By email dated January 13, 2014, the complainant informed the Commission that, after having come to a mediated resolution of the case with the respondents, he was withdrawing his complaint. 

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
