PUBLIC NOTICE
Notice is hereby given that the Department of Environmental Protection, acting in accordance with the provisions of M.G.L. chapter 111, Section 142A through 142E, will offer for public comment the following draft Operating Permit issued pursuant to 310 CMR 7.00: Appendix C.The draft RENEWAL Operating Permit for Irving Oil Terminals Inc. is being issued in accordance with 310 CMR 7.00: Appendix C(6). The resulting permit includes changes made since the last Operating Permit was issued, such as the language included in previously-issued Plan Approval MBR-10-IND-018, the addition of requirements from federal regulations such as 40 CFR Part 63 to Tables 4, 5, 6, and 8, an updated Table 7 reflecting non-subject requirements, and other updates as requested by Irving Oil Terminals Inc. The purpose of the Operating Permit is to codify all of the facility's applicable requirements under the state and federal Clean Air Act, including monitoring, record keeping requirements and emission limitations, into a renewable Operating Permit. This action is required by the U.S. Environmental Protection Agency as stated in its final rule approving the Department's Operating Permit program (Federal Register Vol. 61, No. 95 Wednesday May 15, 1996).

Comments may be submitted via electronic mail to NERO.Air@mass.gov, or via mail to the letterhead address above.
The public comment period will extend until December 29, 2023. Under the provisions of 310 CMR 7.00: Appendix C(6)(f), a public hearing may be requested by any person by submitting a written request to the Regional Office, stating the nature of the issues to be raised at a public hearing. Based on the written request, the Department will determine if a public hearing will be held and a 30 day written notice will be given. The duration of the public comment period shall automatically extend to the close of the public hearing as provided for at 310 CMR 7.00: Appendix C(6)(g).
