The Commissioner of Energy and Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to approve the following application submitted under Section 22a‑208a of the Connecticut General Statutes. Subsequently, the Permit to Construct and Operate No. SW-083-1-C issued on May 7, 1987 and Temporary Authorization No. 20202077-TA issued on February 14, 2020 are no longer in effect and are replaced by this Permit.

Hours of operation: Monday through Friday (6:00 a.m. - 5:00 p.m.) and Saturday (7:00 a.m. - 12:00 p.m.)
Facility maximum storage capacity: 910 cubic yards of Municipal Solid Waste (MSW), of which up to 910 cubic yards may be putrescible MSW. 1,053 cubic yards of Construction and Demolition waste including Oversized MSW, no more than 20 propane tanks, scrap metal, no more than 25 appliances containing chlorofluorocarbon liquids, scrap tires, mixed paper/cardboard, Clean Wood including Land Clearing Debris.
The facility consists of: a site access gate; paved access road and parking area; concrete tipping floors; concrete push walls and retaining walls; truck ramp; a hopper, conveyer, baler system; a one thousand (1,000) gallon oil/water separator; a truck scale; outdoor paved and caged storage area for propane tanks; and outdoor paved storage area for empty trailers or trailers staged for transport. An additional truck scale and scale house are located at 80 Industrial Park Road, a permitted solid waste facility on a parcel contiguous to the proposed location and which is also controlled by the Applicant, and will be used by the Facility.
The following waste materials may be accepted at the facility: (a) Municipal Solid Waste (MSW) including putrescible MSW; (b) Oversized MSW items such as furniture, carpet and mattresses; (c) Construction and Demolition (C&D) waste; (d) Clean Wood including Land Clearing Debris; (e) mixed paper and cardboard; (f) appliances containing chlorofluorocarbon (CFC) liquid; and (g) scrap tires.
Upon written approval granted by the Commissioner, and in accordance with the conditions set forth in the Permit to Construct and Operate, the following waste streams may be accepted at the facility: (a) commingled glass, plastic and metal container; (b) lead-acid batteries; (c) Used Oil; (d) spent anti-freeze, (e) consumer electronics; (f) Universal Wastes; (g) grass clippings; and (h) leaves.

Interested persons may obtain a copy of the application from the applicant’s contact noted above. Copies of the application and the draft permit to construct and operate that normally would be available for inspection at the Department of Energy and Environmental Protection, Bureau of Materials Management and Compliance Assurance, Waste Engineering and Enforcement Division, 79 Elm Street, Hartford, CT from 8:30 a.m. to 4:30 p.m. Monday through Friday and at other times by appointment, may be available once DEEP opens to the public. Before making a final decision on this application, the Commissioner shall consider written comments on the application from interested persons. PETITIONS FOR PUBLIC HEARING
Petitions for a hearing shall be submitted within thirty (30) days from the date of publication of this public notice and should include the application number noted above and also identify a contact person to receive notifications. Petitions should also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition. In order to facilitate the filing of requests for hearing during the COVID-19 emergency and consistent with the Department’s Temporary Directive, the Office of Adjudications will accept electronically-filed petitions in addition to petitions submitted by mail. Petitions with required signatures may be filed by email to deep.adjudications@ct.gov or mailed to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106. Within thirty (30) days of filing the petition, original petitions that were filed electronically must be also be mailed to the Office at the above-noted address. If the original petition exists only in electronic format or signatures were produced using a computer or typewriter, the petition must be submitted with a statement bearing the wet-ink signature of the petitioner that the petition is only available in that format and has been submitted to satisfy the requirement that an original petition be filed.
