Notice of Tentative Determination to Approve Structures, Dredging & Fill and Tidal Wetlands and Water Quality Certificate and Intent to Waive Public Hearing

The Department of Energy & Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to approve the following application submitted under Section 401 of the Federal Clean Water Act, as amended, for a Water Quality Certificate and Sections 22a-361 and 22a-32 of the Connecticut General Statutes (“CGS”) for a permit to conduct work waterward of the coastal jurisdiction line in tidal, coastal or navigable waters of the state and in tidal wetlands for private recreational boating access.   
 
The Commissioner also gives notice of intent to waive the requirement for public hearing pursuant to CGS Section 22a-32 and that the Commissioner shall hold a hearing on receipt of a petition signed by twenty-five (25) or more persons pursuant to CGS Sections 22a-32 and 22a-361(b). The Commissioner also gives notice that a hearing may be held on this application if a written request via electronic mail as specified below is received from the applicant, or if the Commissioner determines that the public interest will best be served thereby.

PROPOSED ACTIVITY
The proposed activity includes dredging with off site upland disposal, construction of a new fixed pier, ramp, floating main dock and finger floats and the establishment of a perimeter and will affect aquatic and coastal resources and tidal wetlands.
 
INFORMATION REQUESTS/PUBLIC COMMENT
Interested persons may obtain a copy of the application from the above contacts or by sending a request for an electronic copy to DEEP at micheal.grzywinski@ct.gov.  All interested parties are invited to express their views on the tentative determination concerning this application.  Comments regarding this application may be submitted via electronic mail to: micheal.grzywinski@ct.gov no later than forty (40) days from the publication date of this notice.  
 
PETITIONS FOR HEARING
Petitions for a hearing shall be submitted within forty (40) days from the date of publication of this public notice and should include the application number(s) noted above and also identify a contact person to receive notifications.  Petitions should also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition.  Upon receipt of a petition, the Commissioner shall take action as required by relevant laws, including Public Act 25-84, which was effective upon passage in June 2025.  The Office of Adjudications will accept electronically-filed petitions in addition to petitions submitted by mail or hand-delivered.  Petitions with required signatures may be sent to deep.adjudications@ct.gov, those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106.  If the signed original petition is only in an electronic format, the petition must be submitted with a statement signed by the petitioner that the petition exists only in that form.  Original petitions that were filed electronically must also be mailed or delivered to the Office of Adjudications within thirty (30) days of electronic submittal.  Additional information can be found at www.ct.gov/deep/adjudications.
