Notice of Intent to Issue the General Permit to Employ a Permitted Environmental Professional

TENTATIVE DETERMINATION

The Commissioner of the Department of Energy and Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to issue the General Permit to Employ a Permitted Environmental Professional to Oversee Cleanup Activities of Releases for Which the Permitted Entity is the Responsible Party and for Certain Tank Removal Companies to Oversee Cleanup of Releases from Residential Underground Heating Oil Storage Tank Systems.

COMMISSIONER’S FINDINGS/REGULATORY CONDITIONS

The proposed general permit, if issued, will require the approval of a registration which identifies permitted environmental professionals (PEPs) to oversee cleanup activities for which the permitted entity is the responsible party and to oversee cleanup activities for certain tank removal companies.

PROPOSED GENERAL PERMIT

The purpose of the general permit is to allow certain entities which have an internal fire department and/or an internal spill response team to cleanup releases for which the permitted entity is the responsible party. Additionally, this general permit provides the ability of certain tank removal companies to cleanup releases from residential underground heating oil storage tank systems.

COMMISSIONER’S AUTHORITY

The Commissioner is authorized to issue this general permit pursuant to section 22a-454 of the Connecticut General Statutes. The Commissioner is authorized to approve or deny any registration under this general permit pursuant to CGS section 22a-454.

Before making a final decision on this proposed general permit, the Commissioner shall consider written comments from interested persons that are received within 30 days from the publication date of this notice.
