Permits to Act as a Contractor to Contain or Remove or Otherwise Mitigate the Effects of a Release

Section 22a-454 of the Connecticut General Statutes (CGS) states that “[n]o person shall … act[ing] as a contractor to contain or remove or otherwise mitigate the effects of discharge, spillage, uncontrolled loss, seepage or filtration of waste oil, petroleum, chemical liquids, or hazardous wastes.

There are two types of permits for acting as a contractor under Section 22a-454 of the CGS:

The individual permit for Permitted Spill Cleanup Contractors allows Permittees that have all necessary expertise and equipment to respond to any release of waste oil or petroleum or chemical liquids or hazardous wastes

The general permit for Registered Existing Release Response Contractors authorizes Registrants to respond to existing (historical) releases of waste oil or petroleum or chemical liquids or hazardous wastes and clean up such releases to soil exclusively at releases that are subject to sections 22a-6(u), 22a-133m, 22a-134a, 22a-133x, 22a-133y, or 22a-449(c) of CGS, releases on sites enrolled in a brownfield program, releases on sites listed on the National Priorities List, and, beginning March 1, 2026, releases subject to the Release-Based Cleanup Regulations

The general permit for Registered Existing Release Response Contractors DOES NOT authorize Registrants to:

  • respond to or address releases that are subject to the Release Reporting Regulations  (22a-450-1 through 6)
  • address PCB contamination at levels over 10 parts per million, or otherwise subject to TSCA
  • contain and remove releases to surface water or perform any surface water or groundwater cleanup
