Call to Order

Acting Chairman Carolyn Futtner called the meeting to order at 10:02am.

Acting Chairman Futtner read the Introductory Statement and called the roll call.  Ten appellants were present, two appellants failed to appear. Ten local Issuing Authorities were present along with the State.

Board Members Present: Acting Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Anthony Iaconis, Esq., Col. Chris Lewis, and Chief Carl Rosensweig.

Board Members Absent: Gudrun Johnson and Stephen Sanetti, Esq.

Acting Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 21-777-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Donald Anderson represented the Local Issuing Authority, Chief Donald Anderson, Darien Police Department.

Withdrawal: The appellant withdrew his case.

2) Case No. 22-007-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Withdrawal: The appellant withdrew his case.

3) Case No. 21-355-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Motion: Board member Chief Rosensweig made a motion for the State Issuing Authority, seconded by Col. Lewis.  The motion was withdrawn by both Chief Rosensweig and Col. Lewis, motion withdrawn. 

This case is being passed until the appellant contacts his criminal attorney. 

4) Case No. 22-528-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Cpt. Garon Delmonte represented the Local Issuing Authority, Chief Keith Mellow, Milford Police Department.

Motion: Board member Atty. Iaconis made a motion for the Appellant, due to the lack of evidence. Motion was seconded by Chief Rosensweig, motion passed unanimously. Motion passed 5-0. 

5) Case No. 21-446-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Dwayne Jones represented the Local Issuing Authority, Chief Edward DeMarco, East Windsor Police Department.

Withdrawal: The appellant withdrew his case.

 

Appellant returned from call to attorney and asked to proceed with his case.

3) Case No. 21-355-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Motion: Board member Chief Rosensweig made a motion for the State Issuing Authority, seconded by Col. Lewis.  The motion was withdrawn by Chief Rosensweig, motion withdrawn. 

Motion: Board member Atty. Iaconis made a motion for the State Issuing Authority, seconded by Col. Lewis.  The motion was withdrawn by both Atty. Iaconis and Col. Lewis, motion withdraw. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

 

6) Case No. 21-334-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board member Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously

7) Case No. 22-021-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Elias Martz represented the Local Issuing Authority, Chief Eric Costa, Middletown Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit, at this time. Vote was 5-0 in favor of the Local Issuing Authority.

8) Case No. 22-023-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Elias Martz represented the Local Issuing Authority, Chief Eric Costa, Middletown Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit, at this time. Vote was 5-0 in favor of the Local Issuing Authority.

9) Case No. 22-022-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Elias Martz represented the Local Issuing Authority, Chief Eric Costa, Middletown Police Department.

Motion: Board member Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Iaconis, motion passed unanimously.

10) Case No. 21-869-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own  behalf.  Lt. Scott Smith represented the Local Issuing Authority, Chief David Kullgren, Newtown Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit, at this time. Vote was 5-0 in favor of the Local Issuing Authority.

11) Case No. 22-092-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  TO Matthew DaSilva represented the Local Issuing Authority, Chief C. Colin McAllister, Naugatuck Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Naugatuck to issue the permit.  Vote was 5-0 in favor of the appellant.

12) Case No. 22-054-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  TO Matthew DaSilva represented the Local Issuing Authority, Chief C. Colin McAllister, Naugatuck Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Naugatuck to issue the permit.  Vote was 5-0 in favor of the appellant.

 

Secretary’s Report:

Board member Col. Lewis made a motion to accept the minutes from January 5, 2023 seconded by Dr. Conrad, motion carried. Atty. Iaconis abstained. Vote was 4-1 to approve.

 

New Business: Discussion on TEAMS. Changing from virtual to In-person.

 

Adjournment: Board member Atty. Iaconis made a motion to adjourn, seconded by Board member Col. Lewis, motion carried. Meeting ended at 2:00pm.
