TEAMS HEARING

 

 

Call to Order

 

Chairman Frank P. Blando called the meeting to order at 10:05am.

Chairman Blando read the Introductory Statement and called the roll call.  TEN appellants were present, four appellants failed to appear. Nine local Issuing Authorities were present along with the State.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Carolyn Futtner Esq., Dr. Cynthia Conrad, Anthony Iaconis, Esq., Gudrun Johnson, Col. Chris Lewis and Chief Carl Rosensweig

Board Members Absent: Stephen Sanetti, Esq.

Chairman Frank P. Blando administered the oath to all witnesses individually.

Hearings: Fourteen cases were heard in the following order:

 

1) Case No. 20-340-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Withdrew: The appellant withdrew his case.

2) Case No. 21-579-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Arthur Weisgerber represented the Local Issuing Authority, Chief Thomas Kulhawilk, Norwalk Police Department.

Withdrew: The appellant withdrew his case.

3) Case No. 21-545-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Angelo Stavrides represented the Local Issuing Authority, Chief Roberto Rosado, Meriden Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

4) Case No. 20-338-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board member Ms. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Atty. Iaconis, motion passed unanimously.

5) Case No. 21-552-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Matthew Clerkin represented the Local Issuing Authority, Chief Jonathan Mulhern, Branford Police Department.

Motion: Board member Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Chief Rosensweig, motion passed unanimously.

6) Case No. 20-347-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Motion: Board member Atty. Iaconis made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Ms. Johnson, motion passed unanimously.

7) Case No. 21-536-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared with a translator.  Lt. Matthew Solak represented the Local Issuing Authority, Chief Paul Hussey, Willimantic Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Chairman Blando, Secretary Futtner, Ms. Johnson and Chief Rosensweig voted in favor of the Local Issuing Authority. Dr. Conrad, Atty. Ioconis and Col. Lewis voted in favor of the Appellant. The vote was 4-3 in favor of the Local Issuing Authority.

8) Case No. 21-508-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Arthur Weisgerber represented the Local Issuing Authority, Chief Thomas Kulhawilk, Norwalk Police Department.

Motion: Board member Ms. Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Atty. Iaconis, motion passed unanimously.

9) Case No. 20-137-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf with one witness. Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

10) Case No. 21-423-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by John C. Drapp, Esq.  Det. Angelo Stavrides represented the Local Issuing Authority, Chief Roberto Rosado, Meriden Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Meriden to issue the temporary pistol permit.  

11) Case No. 20-191-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Continuance:  This case has been continued to May 19, 2022

12) Case No. 21-554-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Nicholas A. Valinshy, Esq. Captain Jeff DePerry represented the Local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department with one witness.

Continuance:  Due to the appellants attorney not receiving the packet from Old Saybrook this case has been continued to May 19, 2022

13) Case No. 21-382-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Town Manager Jim Rivers represented the Local Issuing Authority, Town Manager Jeff Rivers, Town of Windham with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

14) Case No. 21-550-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. David Merriam represented the Local Issuing Authority, First Selectman Derrylyn Gorski, Town of Bethany.

Motion: Chief Rosensweig made a motion in favor of the appellant due to Lt. Merriam stating they would issue if disclosed, seconded by Ms. Johnson. Motion passed unanimously.  Bethany must issue the permit.

 

 

Secretary’s Report:

Atty. Iaconis made a motion to accept the minutes from March 3, 2022, seconded by Board Secretary Futtner, motion carried. Dr. Conrad and Col. Lewis abstained from the vote.

 

New Business:

Discussion on the statute about granting a permit if the IA packet is not received by the appellant within the 10 days rule.

Atty. Iaconis made a motion to adjourn. Seconded by Dr. Conrad, motion carried. Meeting ended at 1:25pm.
