Call to Order

Acting Chairman Carolyn M. Futtner, Esq. called the meeting to order at 10:05am.

Acting Chairman Futtner read the Introductory Statement and called the roll call.  Seven appellants were present, one appellant failed to appear. Five local Issuing Authorities were present along with the State.

Board Members Present: Acting Chairman Carolyn M. Futtner, Esq., Dr. Cynthia Conrad, Anthony Iaconis, Esq., Col. Chris Lewis, Chief Carl Rosensweig, and Stephen Sanetti, Esq.

Board Members Absent: Ms. Gudrun Johnson

Acting Chairman Carolyn M. Futtner administered the oath to all witnesses.

Hearings: Eight cases were heard in the following order:

1) Case No. 20-433-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By a majority decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.  Acting Chairman Futtner, Dr. Conrad, Atty. Iaconis, Chief Rosensweig voted in favor of the State Issuing Authority. Atty. Sanetti voted inf favor of the appellant. Vote was 4-1-1 in favor of the State Issuing Authority.  Col. Lewis stepped out of the hearing at 10:33 and did not vote.

2) Case No. 21-837-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Chief Jeffrey Kreitz represented the Local Issuing Authority, Chief Jeffrey Kreitz, Ridgefield Police Department with one witness.

Motion: Board member Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously. Vote was 5-0-1.  Col. Lewis was out of the hearing and was not included in this vote. 

 

3) Case No. 21-639-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by C. Christian Young, Esq.  Lt. Brian Weir represented the Local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Trumbull to issue the permit. Vote was 5-0-1.  Col. Lewis was not in the hearing and was not included in this vote. 

Col. Lewis returned to the hearing.

4) Case No. 20-440-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 6-0.

5) Case No. 21-717-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 6-0.

6) Case No. 22-729-SD, involving the state denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear but was represented by Atty. Rachel Baird. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Continuance:  This case was continued to November 17, 2022.

7) Case No. 21-733-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Paul Carty, Esq.  Det. Lt. Ethan Mable represented the Local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Motion: Board member Atty. Sanetti made a motion for the appellant, due to the lack of evidence. Motion was seconded by Atty. Iaconis, motion passed unanimously. Vote was 6-0 in favor of the appellant.

8) Case No. 21-760-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. George Bryce represented the Local Issuing Authority, Chief Stephen Pugner. Bethel Police Department.

Motion: Board member Atty. Sanetti made a motion for the Appellant due to the length of time passed. Motion was seconded by Atty. Iaconis, motion passed unanimously.

 

 

Secretary’s Report:

Board member Atty. Iaconis made a motion to accept the minutes from July 21, 2022, seconded by Dr. Conrad., motion carried.
