BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, September 24, 2015, 10am at the

Dept. of Emergency Services and Public Protection, Middletown, CT

Call to Order

Acting Chairman Atty. Craig Fishbein called the meeting to order at 10:00am.

Acting Chairman Fishbein, read the Introductory Statement and called the roll call. Two appellants were present and three failed to appear. The State Issuing Authority was present. Three local Issuing Authorities were present and one failed to appear.

Board Members Present: Secretary Craig C. Fishbein, Esq., Dr. Charles Dike, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Frank P. Blando, Esq.

Acting Chairman Fishbein administered the oath to all witnesses.

Hearings: Five cases were heard in the following order:

1) Case No. 14-537-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Yarsawich represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department.

Decision: By a majority, the Board voted to uphold the decision of the local Issuing Authority, Chief James Wardwell, New Britain Police Department, the denial of a temporary pistol permit. Board Members Dike, Fishbein, Greer, Johnson, Overturf and Rosensweig voted for the local Issuing Authority. Board Member Kuck abstained.

2) Case No. 14-009-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative for the local Issuing Authority, First Selectman Noel Bishop, Town of Westbrook, failed to appear.

Motion: Board Member Kuck made a motion for the appellant, by default, due to the local Issuing Authority Selectman Noel Bishop, Town of Westbrook, failure to appear. The motion was seconded by Board Member Dike, motion carried. The Board ordered a temporary pistol permit to be issued to the appellant.

3) Case No. 14-507-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Joel W. Hurliman, Shelton Police Department.

Motion: Board Member Kuck made a motion to uphold the decision of the local Issuing Authority, Chief Joel W. Hurliman, Shelton Police Department, by default, due to the appellant’s failure to appear. The motion was seconded by Board Member Greer, motion carried.

4) Case No. 14-494-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone appeared for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Kuck made a motion to uphold the decision of State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. The motion was seconded by Board Member Greer, motion carried.

5) Case No. 14-276-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone appeared for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Kuck made a motion to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. The motion was seconded by Board Member Greer, motion carried.

Secretary’s Report:

Board Member Overturf made a motion to accept the September 10, 2015 minutes as written, Johnson seconded the motion, motion carried. Board Members Dike, Greer and Kuck abstained.

New Business: Board Secretary Fishbein informed the Board that a new meeting location was available for 2016 at no cost at the Parks and Recreation Dept. in Wallingford.

Adjournment: Kuck made a motion to adjourn, Greer seconded the motion, motion carried. Meeting adjourned.
