BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Blando called the meeting to order at 10am.

Chairman Blando called the roll call. 8 appellants were present.

The State Issuing Authority was present and 3 local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq.,  Dr. S. David Bernstein, James A. Greer, Esq., Mr. M. Peter Kuck , Col. Kyle Overturf and Chief Carl Rosensweig.

Board Member Absent: Ms. Gudrun Johnson

Chairman Blando administered the oath to all witnesses.

Hearings:

1) Case No. 13-621-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Testi represented the local Issuing Authority, Chief Thomas Kiely, Trumbull Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 14-005-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. DiFederico represented the local Issuing Authority, Chief Leon Krolikowski, New Canaan Police Department.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 13-337-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with one witness. Sgt. Jeff McDermott represented the local Issuing Authority, Mayor John Rodolico, Town of Ledyard with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Mayor John Rodolico, Town of Ledyard, the denial of the appellant’s pistol permit and ordered a temporary pistol permit be issued.

4) Case No. 13-606-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Charles Williams represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit.

5) Case No. 13-529-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Erich H. Gaston represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Fishbein made a motion for the Board to accept the agreement between the appellant and the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, to reinstate the appellant’s pistol permit by August 8, 2014, on the condition of the current suitability and that the appellant hasn’t committed any offence that violates the criminal law and doesn’t have any statutory disqualifying events at that time. Kuck seconded the motion, motion carried unanimously.

6) Case No. 13-609-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Mitchell Lake represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit, at this time.  Chairman Blando recused himself from the vote.

7) Case No. 13-511-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Mitchell Lake represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Fishbein made a motion for the Board to accept the agreement with a stipulation between the appellant and the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, to reinstate the appellant’s pistol permit when the appellant shows proof that has the NRA course was completed and on the condition of the current suitability and that the appellant hasn’t committed any offence that violates the criminal law and doesn’t have any statutory disqualifying events at that time. Kuck seconded the motion, motion carried unanimously.

8) Case No. 13-692-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Kerry J. Robair represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

Secretary’s Report:

  1. Secretary Fishbein made a motion to amend the March 28, 2014 minutes to correct the name Gudrun to Johnson in the Secretary’s report. Kuck seconded the motion, motion carried unanimously.

  2. Secretary Fishbein made a motion to accept the March 28, 2014 minutes as amended. Kuck seconded the motion, motion carried unanimously.

  3. Executive Session: Secretary Fishbein made a motion to go into Executive Session to discuss C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(c). Kuck seconded the motion, motion carried unanimously.

  4. Executive Session: Secretary Fishbein made a motion to come out of Executive Session to discuss C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(c). Kuck seconded the motion, motion carried unanimously.
