BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Joseph T. Corradino, Esq. called the meeting to order at 12:00pm.

Chairman Corradino swore in new member Chief Carl Rosensweig, a representative of the CT State Association of Chiefs of Police.

Chairman Corradino called the roll call. 11 appellants were present. The State Issuing Authority was present and 4 local Issuing Authorities were present.

Board Members Present: Chairman Joseph T. Corradino, Esq., Chief Carl Rosensweig, Attorney Craig Fishbein, Attorney Jay Greer, Mr. M. Peter Kuck, Mr. Kenneth Tramadeo and Col. Kyle Overturf.

Chairman Joseph T. Corradino administered the oath to all witnesses.

Election of the Secretary of the Board:

Attorney Craig Fishbein nominated Kenneth V. Tramadeo to be the Board Secretary for a term of two years, Mr. Kuck seconded the nomination, motion carried unanimously.

Hearings:

1) Case No. 13-304-R, Dereck Sawrun, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant, Dereck Sawrun, withdrew his appeal and will reapply for a non-resident pistol permit.

2) Case No. 13-362-D, Jhauntel Butler, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, the denial of a temporary pistol permit.

3) Case No. 14-194-D, Philip Beer, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Al Russo represented the local Issuing Authority, Chief Alan Baker, Danbury Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Alan Baker, Danbury Police Department and voted for Mr. Beer to be issued a temporary pistol permit.

4) Case No. 13-061-R, Robert Wazilewski, II, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Wazilewski’s pistol permit, at this time.

5) Case No. 13-294-SD, John Christophy, involving the State Denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Agreement: The State Issuing Authority agreed to issue the appellant, Christophy, his pistol permit on January 10, 2014 if the appellant does not violate any laws and doesn't call into question his suitability. The appellant will be placed at the top of the appeal list should he not receive his permit at the end of the agreement.

6) Case No. 13-311-R, Christina Seaman (Patchell), involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Seaman’s pistol permit.

7) Case No. 13-323-D, John Gleason, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with one witness. Lt. Brian Herwerth represented the local Issuing Authority, Chief David A. Caron, Glastonbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief David A. Caron, Glastonbury Police Department, to deny the appellant, Gleason, a temporary pistol permit, at this time.

8) Case No. 13-391-R, Wayne DeCarlo involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for the appellant, DeCarlo, to have his pistol permit reinstated.

9) Case No. 13-397-R, David Roper, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and voted for the appellant, DeCarlo, to have his pistol permit reinstated. Corradino, Fishbein, Kuck, Overturf and Tramadeo voted for the appellant. Greer and Rosensweig voted for the State Issuing Authority.

10) Case No. 12-339-D (b), Joseph Ruvolo, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Jose Claudio appeared on behalf of the local Issuing Authority, First Selectman Lisa Pellegrini, Town of Somers.

Agreement: The appellant, Ruvolo, agreed to withdraw his appeal and the local Issuing Authority agreed to issue a temporary pistol permit after the appellant agrees to show proof of residency. The permit will be issued no later than Nov. 1, 2013. The appellant will be placed at the top of the appeal list should he not receive his permit at the on the end of the agreement.

11) Case No. 13-335-R, Paul Dente, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Cliff Comford appeared on behalf of the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Agreement: The State Issuing Authority agreed to issue the appellant, Dente, his pistol permit on February 10, 2014 if the appellant does not violate any laws and doesn't call into question his suitability. The appellant will be placed at the top of the appeal list should he not receive his permit at the end of the agreement.

Secretary’s Report: Corradino asked for a motion to approve the September 12, 2013 minutes. Tramadeo made a motion, Overturf seconded the motion, motion carried.
