BOARD OF FIREARMS PERMIT EXAMINERS

Thursday October 11, 2012, 12:00pm at the

Wethersfield Police Department, Wethersfield, CT 06109

Call to Order

Secretary T. William Knapp called the meeting to order at 12:00pm.

Secretary Knapp called the roll call 9 appellants were present, 1 appellant absent, the State Issuing Authority was present and 4 local Issuing Authorities were present.

Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, (Ret.), Board Secretary, Mr. M. Peter Kuck, Col. Kyle Overturf and Mr. Kenneth Tramadeo

Board Members Absent: Atty. Jay Greer

Knapp made a motion to move Case No. 12-204-R from fourth case on the agenda to second on the agenda due to the officer need to leave for a funeral. Kuck seconded the motion, motion carried.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

Hearings

1) Case No. 12-230-R, Anthony D. Ballerini, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with two witnesses. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness. 

Decision: By a majority, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time. Tramadeo voted for the appellant. Corradino, Knapp, Kuck and Overturf voted for the State Issuing Authority, Commissioner Reuben F. Bradford.

2) Case No. 12-164-D Kelly D. Mason, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Lt. Sampson represented the local Issuing Authority Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a majority, the Board voted to uphold the denial of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, at this time. Corradino voted for the appellant. Knapp, Kuck, Overturf and Tramadeo voted for the local Issuing Authority.

3) Case No. 12-268-D, Daniel Butkievich, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman George Temple, Town of Oxford represented the local Issuing Authority with one witness.

Agreement: The local Issuing Authority agreed to issue a temporary pistol permit and the appellant agreed to withdraw his appeal.

4) Case No. 12-204-R, Jory McNab involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time. Kuck andTramadeo voted for the appellant. Corradino, Knapp and Overturf voted for the State Issuing Authority, Commissioner Reuben F. Bradford.

5) Case No. 12-205-R, Eric Altieri, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to overturn the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for Mr. Altieri to have his pistol permit reinstated.

6) Case No. 12-202-R, Johalen Rodgriguez, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant and his attorney failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted for the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, for the appellant’s failure to appear.

7) Case No. 12-262-D, Roger R. Panciera, Jr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. John R. Fiori represented the local Issuing Authority, Chief Darren Stewart, Stonington Police Department.

Decision: By a unanimous6 decision, the Board voted to overturn the denial of the local Issuing Authority, Chief Darren Stewart, Stonington Police Department and voted for Mr. Panciera, Jr. to be issued a temporary pistol permit.

8) Case No. 12-203-D, Terence M. Valley, involving the denial pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Officer Alfred Mayo represented the local Issuing Authority, Chief Brent Larabee, East Haven Police Department.

Attorney Sherman requested a continuance due to 10 days notice did not give him enough time to get the appellant’s medical history.

Decision: By a unanimous decision, the Board voted to against the request. Attorney Sherman advised the Board that his client, Mr. Valley, withdrew his appeal.

9) Case No. 12-301-D, Arthur A. Guertin involving the denial pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Dan Dzamko represented the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department. 

Decision: By a unanimous decision, the Board voted to uphold the denial of the local Issuing Authority, Chief Carl Shawn Boyne, New Milford Police Department. 

*Sgt. D”Alessandro, Dept. of Emergency Service and Public Protection, notified the Board at the hearing, that Mr. Michael Brown had his permit reissued prior to the hearing.

Secretary’s Report:

1) Approval of August 9, 2012 Minutes. Corradino made a motion to accept the minutes as written, Tramadeo seconded the motion, motion carried.

D. Old Business:

1) Request for a Declaratory Ruling. Knapp made a motion to table the request, Overturf seconded the motion, motion carried.
