BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, three appellants failed to appear. The State Issuing Authority and six local Issuing Authorities were present and two Issuing Authorities failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Mr. M. Peter Kuck, Chief Carl Rosensweig and Carolyn Futtner, Esq..

Board Members Absent: Ms. Gudrun Johnson

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Ten were heard in the following order:

1) Case No. 17-257-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief Krasicky represented the local Issuing Authority, Plymouth Police Department.

Motion: Board Member Overturf made a motion to find for the Issuing Authority due to the Appellants failure to appear seconded by Mr. Kuck.  Motion carried unanimously.

2) Case No. 17-461-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kin Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Board Member Overturf made a motion to find for the Issuing Authority due to the Appellants failure to appear seconded by Mr. Kuck.  Motion carried unanimously.

3) Case No. 17-230-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection

Motion: Board Member Overturf made a motion to find for the Issuing Authority due to the Appellants failure to appear seconded by Dr. Sledge.  Motion carried unanimously.

4) Case No. 17-258-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Kevin Chamberlin, Esq. Lt. LeRose represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department with one witness.

Decision: By a unanimous decision, the Board voted for the appellant and order Danbury to issue the temporary permit.

5) Case No. 17-136-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Lt. Spencer Cerruto was the representative for the local Issuing Authority, Chief John Gavallas, Watertown Police Department with one witness.

Decision: By majority decision, the Board voted to uphold the decision of the local Issuing Authority, Chief John Gavallas, the denial of the pistol permit.  Chairman Blando and Board member Kuck voted in favor of the appellant. Col. Overturf, Atty. Futtner, Chief Rosensweig, and Dr. Sledge voted against the appellant.

6) Case No. 17-065-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Joseph Sastre, Esq. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdraw: Appellant withdrew his case with an agreement with SLFU.

7) Case No. 17-362-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. A representative failed to appear for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Motion: Board Member Col. Overturf made a motion in favor of the appellant. Board Member Kuck seconded the motion, motion passed unanimously.

8) Case No. 17-424-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  A representative failed to appear for the local Issuing Authority, First Selectman, Patricia DelMonaco , Town of New Fairfield.

Motion: Board Member Col. Kuck made a motion in favor of the appellant. Board Member Sledge seconded the motion, motion passed unanimously.

9) Case No. 17-353-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Krodel represented the local Issuing Authority, Chief Brett Mahoney, Waterford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision for the Issuing Authority the denial of the appellants pistol permit.

10) Case No. 18-066-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision for the Issuing Authority the denial of the appellants pistol permit.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the February 15, 2018 minutes as submitted, Chief Rosensweig seconded the motion, motion carried.

New Business: Col. Kyle Overturf announced his retirement as of June 1, 2018. Will continue until seat is filled.

Adjournment: Dr. Sledge made a motion to adjourn, Secretary Col. Overturf seconded the motion, motion carried. Meeting ended at 1:05pm
