Call to Order
Secretary T. William Knapp called the meeting to order at 12:00pm.
Knapp called the roll call, 5 appellants were present, 1 appellant was absent, State Issuing Authority was present and 1 local Issuing Authority, and a representative from New Haven Police Dept. was absent.
Knapp read the Introductory Statement and
Chairman Joseph T. Corradino, Esq. arrived 12:10 and administered the oath to all witnesses.
Board Members Present: Mr. Arthur Carr, Chairman Joseph T. Corradino, Esq., Chief T. William Knapp (Ret.), Mr. M. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo.
Board Members Absent: none, one vacancy
Secretary’s Report:
1) Approval of October 13, 2011 Minutes. Kuck made a motion to move approval of the minutes to the beginning of the agenda, Overturf seconded the motion, motion carried. Tramadeo made a motion to approve the minutes. Kuck seconded the motion, motion carried.
Cases scheduled for hearings:
1) Case No. 11-54-R, Roosevelt Terry, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Decision: By a unanimous decision, the Board members voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and voted for Mr. Terry to be reinstated his pistol permit.
2) Case No. 10-169-R. Alvaro Albuquerque, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.
Decision: By a majority, the Board members voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection at this time. Carr, Corradino, Kuck and Overturf voted for the State Issuing Authority at this time. Knapp and Tramadeo voted for the appellant.
3) Case No. 11-26-D, Bryan Younger, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, Chief Dean Esserman, New Haven Police Department, or a representative for Chief Esserman failed to appear.
Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department, by default, for failure to appear. The Board voted for
4) Case No. 11-68-R, Audrey Lacapruccia, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Captain Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Decision: By a unanimous decision, the Board members voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.
5) Case No. 11-53-R, Jonathan Nevins, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney James A. Saraceni represented the appellant with one witness. Captain Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with three witnesses.
Decision: By a majority, the Board members voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, revocation of the appellant’s pistol permit. Carr, Corradino, Knapp, Overturf and Tramadeo voted for State Issuing Authority. Kuck voted for the appellant.
6) Case No. 11-98-R, Armand Dupuis, Jr., involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Alaric Fox represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Decision: By a unanimous decision, the Board members voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Dupuis's pistol permit.
