Call to Order

Chairman Joseph T. Corradino, Esq. called the meeting to order at 12:00pm.

Chairman Corradino called the roll call, 11 appellants were present, 1 appellant was absent and 5 local Issuing Authorities were present.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

Board Members Present: Mr. Arthur Carr, Chairman Joseph T. Corradino, Esq., Secretary

T. William Knapp, Mr. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo.

Board Members Absent: one vacancy

Cases scheduled for hearings:

1) Case No. 11-215-D, Jave Gray, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness.  Lt. Mark Samsel represented the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department and voted for Mr. Gray to be issued a temporary pistol permit.

2) Case No. 11-137-D, Jose Guzman, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Donna Lemaire represented the local Issuing Authority, Chief Mark Sirois, East Hartford Police Department.

  

Withdrawl: The appellant, Mr. Guzman, withdrew his appeal due a conviction of misdemeanor handgun disqualifier.

3) Case No. 10-346-D, Donald Riles, Jr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer Jacqualine Hoite represented the local Issuing Authority Chief Dean Esserman, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department and voted for Mr. Riles to be issued a temporary pistol permit.

4) Case No. 11-30-D, Demetrius Brooks, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Jacqualine Hoite represented the local Issuing Authority Chief Dean Esserman, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department and voted for Mr. Brooks to be issued a temporary pistol permit.

5) Case No. 11-285-D, Christopher Tagariello, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Captain Fred Hall represented the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Tagariello, to be issued a temporary pistol permit.

6) Case No. 11-156-D, Alfredo Rodriguez, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Captain Fred Hall represented the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Rodriguez, to be issued a temporary pistol permit.

7) Case No. 11-146-D, Edward Steigauf, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Steigauf, to be issued a temporary pistol permit.

8) Case No. 11-173-D, James Marcoux, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Marcoux, to be issued a temporary pistol permit.

9) Case No. 11-117-D, Kevin T. Rogers, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Rogers, to be issued a temporary pistol permit.

10) Case No. 11-261-D, Wayne Murray, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. Murray, to be issued a temporary pistol permit.

11) Case No. 11-94-D, Julio Cancel, Jr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Motion: Chairman Corradino made a motion that the case was dismissed for lack of jurisdiction and the appeal is moot. Motion carried.

12) Request for a continuance from Mr. Daniel Majeed:

Motion: Mr. Kuck made a motion to dismiss the appeal since the appellant, Mr. Majeed, did not fulfill the requirements that Secretary Knapp required. Motion was not seconded.

Motion: Chairman Carradino called for a motion to add Case 11-246-D, Daniel Majeed vs. Chief Gerald Narowski, Derby Police Department, to the agenda. Secretary Knapp made the motion to add Majeed to the agenda at number 12. Overturf seconded the motion. Chairman Corradino, Secretary Knapp, Tramadeo and Overturf voted in favor of the motion. Kuck abstained. Motion carried.

Withdrawl motion: Kuck withdrew his original motion.

 Case No. 11-246-D, Daniel Majeed, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Detective Charles Stankey represented Chief Gerald Narowski, Derby Police Department. 

Motion: Secretary Knapp made a motion to find for the local Issuing Authority, Derby Police Department, by default, for the appellant’s failure to appear. Tramadeo seconded the motion. Motion carried unanimously. Chairman Corradino stated in addition to the motion, that it is the finding of the Board that the appellant is barred from a hearing before the Board because of a pending protective order. Knapp seconded the motion. Motion carried unanimously.

Approval of November 10, 2011 Minutes: Secretary Knapp made a motion to approve the minutes. Kuck seconded the motion, motion carried.

2) Chairman Corradino stated a motion that it is the Order of the Board to apply to the Attorney General for a Writ of Mandamus against Chief Gerald Narowski, Derby Police Department to issue pursuant to the order of the Board in the Case (11-63-D) Berube vs. Derby Police Department. Motion carried.

Motion to adjourn: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried.
