A. Call to Order

Acting Chairman James Finnerty called the meeting to order at 12:00pm and called the roll call of appellants and Board Members.

16 appellants were present and four appellants were absent.

Board Members Present: Mr. Arthur Carr, Attorney James T. Finnerty, Chief T. William Knapp (Ret.), Mr. M. Peter Kuck, and Mr. Kenneth V. Tramadeo.

Board Members Absent: Attorney Joseph Corradino and Colonel Kyle Overturf.

Acting Chairman Finnerty read the Introductory Statement and Administered the Oath to all witnesses.

Cases scheduled for hearings:

1) Case No. 10-195-D, Vincent Meli, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative of the local issuing authority, Chief John J. Buturla, Stratford Police Department was present.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the local Issuing Authority, Chief John J. Buturla, Stratford Police Department, by default due to the appellant’s failure to appear.

2) Case No. 10-161-D, Michael Gay involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative of the local issuing authority, Chief Paul Melanson, Farmington Police Department was present.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the local Issuing Authority, Chief Paul Melanson, Farmington Police Department, by default due to the appellant’s failure to appear.

3) Case No. 10-94-D, Jose Cruz involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Bob Pekrul represented the local Issuing Authority, Chief Jeffrey Cossette, Meriden Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Jeffrey Cossette, Meriden Police Department and voted for Mr. Cruz to be issued a temporary pistol permit.

4) Case No. 10-254-D, Cory Miranda involving the denial of his temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. John A. Zematis represented the local Issuing Authority, Chief Richard Mulhall, Newington Police Department.

Withdrew appeal: Mr. Miranda and local Issuing Authority agreed that he would withdraw the appeal and reapply with correct information regarding arrest history. The local Issuing Authority agreed that as long as there are no other events that are detrimental to Mr. Miranda’s suitability, he will be issued a temporary permit.

5) Case No. 10-225-D, John Picarazzi, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Vincent Noce, Jr. represented the appellant.  Lt. McCauly represented the local Issuing Authority, Chief John L. Salvatore, Monroe Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief John L. Salvatore, Monroe Police Department and voted for Mr. Picarazzi to be issued a temporary pistol permit.

6) Case No. 10-224-D, Robert MacDonald, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Mark Palmer, Coventry Police Department, as the local Issuing Authority was present.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Mark Palmer, Coventry Police Department and voted for Mr. MacDonald to be issued a temporary pistol permit.

7) Case No. 10-208-D, Victor Swanson involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Mark Palmer, Coventry Police Department, the local Issuing Authority was present.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Mark Palmer, Coventry Police Department and voted for Mr. Swanson to be issued a temporary pistol permit.

8) Case No. 10-221-D, David Mara, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Gary Collins represented the local Issuing Authority, Chief Cark J. Sferrazza, Enfield Police Department.

Decision: By a majority, the Board members voted to overturn the decision of the local Issuing Authority, Chief Cark J. Sferrazza, Enfield Police Department and voted for Mr. Mara to be issued a temporary pistol permit. Carr, Finnerty, and Tramadeo voted for the appellant. Knapp and Kuck voted for the local Issuing Authority.

9) Case No. 10-185-R, Kenneth Langlois, involving the revocation of a state pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety with two witnesses.

Decision: By a majority, the Board members voted to uphold the decision of the State Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety, the revocation of Mr. Langlios pistol permit at this time. Carr, Finnerty, Knapp and Tramadeo voted for the Issuing Authority. Kuck voted for the appellant.

10) Case No. 10-184-R, William Newton involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Andrew Matthews, representing the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety was present.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety, by default due to the appellant’s failure to appear.

11) Case No. 10-211-R, Peter Toschi involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety, and voted to reinstate Mr. Toshchi’s pistol permit.

12) Case No. 10-149-R, Daniel Febus, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety with one witness.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety, and voted to reinstate Mr. Febus’s pistol permit.

13) Case No. 10-160-R, Todd Jennings, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety with one witness.

Decision: By a majority, the Board members voted to uphold the decision of the Issuing Authority, Acting Commissioner Stebbins, Department of Public Safety, the revocation of Mr. Jennings pistol permit. Knapp, Kuck and Tramadeo voted for the Issuing Authority. Carr and Finnerty voted for the appellant.

14) Case No. 10-238-D, Fabrizio Trombetta, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Christopher M. Silva represented the appellant. Sgt. Kim Nikola represented the local Issuing Authority, Acting Chief Joseph Gaudett, Bridgeport Police Department.

Withdrew appeal: Mr. Trombetta and local Issuing Authority agreed that Mr. Trombetta would withdraw the appeal. Mr. Trombetta will reapply with truthful information on his application and the local Issuing Authority agreed Mr. Trombetta will be issued a temporary permit.

15) Case No. 10-186-D, Victor Hurtado, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Weisgerber represented the local Issuing Authority, Chief Harry Rilling, Norwalk Police Department.

Withdrew appeal: Mr. Hurtado and local Issuing Authority agreed that Mr. Hurtado  would withdraw the appeal and he will reapply with truthful information on his application regarding his address and arrest history.

16) Case No. 10-248-D, Sean Howard, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Perry represented the local Issuing Authority Chief John Daly, Southington Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief John Daly, Southington Police Department and voted for Mr. Howard to be issued a temporary pistol permit.

17) Case No. 10-286-D, Wilberto Betancourt, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Susan Wilson represented the local Issuing Authority, Chief Marc Montminy, Manchester Police Department.

Withdrew appeal: Mr. Betancourt and local Issuing Authority agreed that Mr. Betancourt would withdraw the appeal and he will reapply with new information.

18) Case No. 10-91-D, Anthony Vaccaro, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local issuing authority, Chief Brent Larrabee, Stamford Police Department was present.

Withdrew appeal: Mr. Vaccaro and local Issuing Authority agreed that Mr. Vaccaro would withdraw the appeal and he will reapply once the New York Court confirms the correct information regarding his arrest history in New York.  

19) Case No. 10-285-D, Jonathan Brenes, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local issuing authority, Chief Edward L. Stephens, Wolcott Police Department, was present.

Withdrew appeal: Mr. Brenes withdrew his appeal because he is barred from an appeal due his arrest history with Misdemeanor Handgun Disqualification.

20) Case No. 10-218-D, Anastas Kiosse involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative of the local issuing authority, Chief John Karajanis, West Haven Police Department, was present.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the local Issuing Authority, Chief John Karajanis, West Haven Police Department, by default due to the appellant’s failure to appear.

Secretary’s Report:

1) Knapp made a motion to approve the February 24, 2011 Minutes as written. Tramadeo seconded the motion, Motion carried. Finnerty abstained.

Motion to adjourn: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried. The meeting adjourned at 4:55pm.
