A. Call to Order

Chairman Corradino called the meeting to order at 12:00pm, July 14, 2011 and called the roll call of appellants and Board Members.

23 appellants were present, 2 were absent.

Board Members Present: Mr. Arthur Carr, Chairman Joseph T. Corradino, Esq., Chief T. William Knapp (Ret.), Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo.

Board Members Absent: Peter Kuck

Chairman Corradino read the Introductory Statement and Administered the Oath to all witnesses.

B. Cases scheduled for hearings:

1) Case No. 10-268-D, Michael Pepe, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Officer Nicholas Spratto represented the local issuing authority Chief John Daly, Southington Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief John Daly, Southington Police Department and voted for the appellant, Mr. Pepe, to be issued a temporary pistol permit.

2) Case No. 10-322-D, Mark Bedell, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant.  Sgt. Peter Parks represented the local issuing authority Chief Keith Mello, Milford Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Keith Mello, Milford Police Department and voted for the appellant, Mr. Bedell, to be issued a temporary pistol permit.

3) Case No. 11-40-D, James Valentino involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Detective Joseph Lobo represented the local issuing authority, Chief Eric Osanitsch, Bristol Police Department.

Withdrawl: The appellant withdrew his appeal and will reapply with correct and complete information on his pistol permit application.

4) Case No. 10-298-R, Kenneth Krzynowek involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Peter W. Soulsby represented the appellant. Captain Aleric Fox represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety. 

Decision: By a majority, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety, the revocation of Mr. Krzynowek’s pistol permit at this time. Carr, Corradino, Knapp and Overturf voted for the Issuing Authority. Tramadeo voted for the appellant.

5) Case No. 11-63-D, Joseph Berube involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with 3 witnesses. Detective Charles Stankye represented the local Issuing Authority Chief Gerald Narowski, Derby Police Department.

Decision: By a majority, the Board members voted to overturn the decision of the local Issuing Authority Chief Police Gerald Narowski, Derby Department and voted for Mr. Beribe to be issued a temporary pistol permit. Carr, Knapp, Overturf and Tramadeo voted for the appellant. Corradino voted for the local Issuing Authority.

6) Case No. 11-42-D, George Perez involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  A representative of the local Issuing Authority, Chief Fuchs, Redding Police Department, failed to appear.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Douglas S. Fuchs, Redding Police Department, and voted for Mr. Perez to be issued a temporary pistol permit by default.

7) Case No. 11-83-D, Ruani Beck, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant.  A representative of the local Issuing Authority, Chief McMahon, Middletown Police Department, failed to appear.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Patrick T. McMahon, Middletown Police Department, and voted for Mr. Beck to be issued a temporary pistol permit by default.

8) Case No. 10-314-R, Jackie Toon involving the revocation of his pistol permit to carry pistols and revolvers. Attorney John O’Brien represented the appellant. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Toon’s pistol permit at this time.

9) Case No. 10-325-D, William Illingworth, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Mr. Illingworth’s pistol permit.

10) Case No. 11-01-R, Kenneth Tardie, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Mr. Tardie’s pistol permit.

11) Case No. 11-10-R, Richard Pape, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection.

Agreement: Mr. Pape and Captain Fox, Department of Emergency Services and Public Protection, stated for the record that the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection agreed to reissue Mr. Pape’s pistol permit in 18 months on January 14, 2013 on the condition there would be no other disqualifiers. Mr. Paper withdrew his appeal.

12) Case No. 11-11-R, Alfred Ranieri, III, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Ranieri’s pistol permit.

13) Case No. 11-21-R, Jerry Butz, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Mr. Butz’s pistol permit.

14) Case No.11-31-R, David Williams, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. William’s pistol permit. Carr, Corradino, Knapp and Overturf voted for the Issuing Authority. Tramadeo voted for the appellant.

15) Case No. 11-55-R, Roxanne Johnson, involving the revocation of her pistol permit to carry pistols and revolvers. Attorney Michael Georgetti represented the appellant. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Ms. Johnson’s pistol permit at this time.

16) Case No. 11-29-R, Eric Kristoffersen, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Kristoffersen’s pistol permit. Col. Overturf recused himself for the vote.

17) The appellant, Mr. Parker, withdrew his appeal prior to the hearing.

18) Case No. 10-317-R, Brian Bousquet, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Mr. Bousquet’s pistol permit.

19) Case No. 10-336-R, Margaret Gallent, involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf with 2 witnesses. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Ms. Gallent’s pistol permit. Carr, Knapp, Overturf and Tramadeo voted for the appellant. Corradino voted for the Issuing Authority.

Chairman Corradino noted for the record that it is Friday, July 15, 2011, 12:28am and the Board had been conducting hearings since 12:00 noon, Thursday, July 14th and recessed only for bathroom breaks.

20) Case No. 10-314-R, Edward Whalen, Jr., involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Whalen’s pistol permit.

21) Case No. 11-48-R, William Masikiewicz, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Masikiewicz’s pistol permit by default for failure to appear.

22) Case No. 10-303-R, Peter Naiden, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant left the hearing with no explanation before his case was heard. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Naiden’s pistol permit by default for failure to appear.

23) Case No. 11-69-R, Mark Wither, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant.  Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Wither’s pistol permit.

24) Case No. 11-86-R, Richard Kocielo, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, and voted to reinstate Mr. Kocielo’s pistol permit. Carr, Knapp, Overturf and Tramadeo voted for the appellant. Corradino voted for the Issuing Authority at this time.

Chairman Corradino noted for the record that it is 4:05AM Friday, July 15, 2011 and the Board had been in session for 16 hours since 12:00 noon, Thursday, July 14th and recessed only for bathroom breaks.

25) Case No. 10-278-R, Thomas Kibbie, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with 2 witnesses.  Capt. Alaric Fox represented the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection with 4 witnesses.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Rueben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Kibbie’s pistol permit.
