BOARD OF FIREARMS PERMIT EXAMINERS
Thursday, December 8, 2016, 10am at the
Wethersfield Police Department, 250 Silas Deane Hwy.
Call to Order
Chairman Frank Blando called the meeting to order at 10:00am.
Chairman Blando read the Introductory Statement called the roll call. 10 appellants were present, 2 failed to show. The State Issuing Authority and 6 local Issuing Authorities were present, 2 failed to show.
Board Members Present: Chairman Frank Blando, Mr. Peter Kuck, Col. Kyle Overturf, Chief Carl Rosensweig, and James Greer, Esq.
Board Members Absent: Dr. Charles Dike and Ms. Gudrun Johnson
Chairman Blando administered the oath to all witnesses.
Hearings: 12 cases were heard in the following order:
1) Case No. 16-436-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Ralph D. Sherman. Chief Viadero was present for the local Issuing Authority, Newtown Police Department.
Motion: Board member Kuck made a motion to find for the appellant, there was no second, motion failed. Motion was reopened by Mr. Kuck and 2nd by Col. Overturf. By majority vote, the Board decided to find for the appellant. Board members Chairman Blando, Mr. Greer, Mr. Kuck and Col. Overturf voted for the appellant and Rosensweig voted against the appellant.
2) Case No. 15-446-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Terri Boyko was the representative of the local Issuing Authority, Chief Brian Gould, Bristol Police Department.
Decision: By majority decision, the Board voted to uphold the decision of the local Issuing Authority Chief Brian Gould, Bristol Police Department at this time. Chairman Blando, Board members Greer, Rosensweig and Col. Overturf voted against the appellant and Mr. Kuck voted for the appellant.
3) Case No. 15-281-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Attorney Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection.
Agreement: Appellant withdrew. State will issue permit
4) Case No. 15-395-R involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection.
Motion: Board member Overturf made a motion to find for the State Issuing Authority, Dora B. Schriro, Dept. of Emergency Services, by default, due to appellant’s failure to appear. Kuck seconded the motion, motion carried unanimously.
5) Case No. 15-485-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman, Mark Walter, local Issuing Authority for the town of East Haddam failed to appear.
Motion: Board Member Overturf made a motion to find for the appellant, by default, due to the Issuing Authority, East Haddam, failure to appear. Kuck seconded the motion, motion carried unanimously.
6) Case No. 15-510-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. An officer represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.
Motion: Board Member Overturf made a motion to find for the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, by default, due to appellant’s failure to appear. Kuck seconded the motion, motion carried unanimously.
7) Case No. 15-474-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Jonathan Fontneau, local Issuing Authority Stamford Police Department failed to appear.
Motion: Board Member Greer made a motion to find for the appellant, by default, due to the Issuing Authority, Stamford, failure to appear. Kuck seconded the motion, motion carried unanimously.
8) Case No 15-449-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. John Williams represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department with 1 witness.
Decision: By unanimous decision, the Board decided to find for the appellant.
9) Case No. 16-004-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman. Det. John Williams represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.
Motion: By majority vote, the Board voted to overturn the decision of the local Issuing Authority and ordered a temporary pistol permit be issued. Chairman Blando, Board members Overturf, Rosensweig and Kuck voted for in favor of the appellant, Mr. Greer voted against the appellant.
10) Case No. 15-321-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Attorney Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection.
Decision: By unanimous decision, the Board decided to uphold the denial for the State Issuing Authority.
11) Case No. 15-454-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Panton represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.
Motion: By majority decision, the Board voted to uphold the decision of the local Issuing Authority Chief Patrick Ridenhour, Stratford Police Department at this time. Board members Greer, Rosensweig and Kuck voted against the appellant and Chairman Blando and Col. Overturf voted for the appellant.
12) Case No. 15-569-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Atty. Joseph Scully represented the local Issuing Authority, Chief James Wardwell New Britain Police Department with 2 witnesses.
Motion: By majority decision, the Board voted to uphold the decision of the local Issuing Authority Chief James Wardwell, New Britain Police Department at this time. Board members Greer, Rosensweig and Kuck voted against the appellant and Chairman Blando and Col. Overturf voted for the appellant.
Secretary’s Report:
Board member Greer made a motion to accept the December 8, 2016 minutes as written, Board Member Kuck seconded the motion, motion carried. Chairman Blando abstained
