Call to Order

Chairman Joseph T. Corradino, Esq. called the meeting to order at 12:00pm.

Mr. Jay Greer was sworn in as a new member of the Board.

Chairman Corradino called the roll call, 9 appellants were present and 1 appellant was absent. The State Issuing Authority and 3 local Issuing Authorities were present and 2 local Issuing Authorities were absent.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

Board Members Present: Chairman Joseph T. Corradino, Esq., Secretary T. William Knapp, Mr. Arthur Carr, Mr. Jay Greer, Mr. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo.

Cases scheduled for hearings:

1)Case No. 11-142-R, Sean Booska, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Robert Fitzgerald represented the appellant. State Sgt. D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with three witnesses.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Booska’s pistol permit, at this time. Kuck voted for the appellant. Carr, Greer, Corradino, Knapp, Tramadeo, and Overturf voted for the Issuing Authority at this time.

2) Case No. 11-200-D, Elaine Casey, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. A representative for the local Issuing Authority, Chief John Karajanis, Jr., West Haven Police Department failed to appear.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief John Karajanis, Jr., West Haven Police Department, for failure to appear. The Board voted for Ms. Casey to be issued a temporary pistol permit by default.

3) Case No. 11-92-R, Harry Dunkley, Jr. involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. State Sgt. D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawl: The appellant withdrew his appeal due to an active protective order.

4) Case No. 11-141-R, Angel Soto, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. State Sgt. D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.

5) Case No. 11-228-D, Joseph Champagne, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local Issuing Authority, First Selectman Richard Shuck, Town of Stafford, failed to appear.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, First Selectman Richard Shuck, for failure to appear. The Board voted for Mr. Champagne to be issued a temporary pistol permit by default.

6) Case No. 11-194-D, Janusz Zdanowski, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Harold Gannon represented the local Issuing Authority, Chief William A. Gagliardi, New Britain Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief William A. Gagliardi, New Britain Police Department. The Board voted for Mr. Zdanowski to be issued a temporary pistol permit.

7) Case No. 11-183-R, Marven Moss, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. State Sgt. D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Moss’s pistol permit, at this time. Kuck, Knapp and Tramadeo voted for the appellant. Carr, Greer, Corradino and Overturf voted for the Issuing Authority at this time.

8) Case No. 11-168-R, Robert Koether involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. State Sgt. D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Koether’s pistol permit, at this time.

9) Case No. 11-263-D, Carlos Sanchez, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer Cory Caserta represented the local Issuing Authority Chief Robert Nivakoff, Stamford Police Department.

Decision: The Board unanimously upheld the decision of  the local Issuing Authority, Chief Robert Nivakoff, Stamford Police Department to deny the appellant, Mr. Sanchez, a pistol permit due to a felony conviction, a disqualifier under State Statute 29-28.

10) Case No. 11-251-D, Joao DaSilva, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Jason Reid represented the local Issuing Authority, Chief John Karajanis, Jr., Avon Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief John Karajanis, Jr., Avon Police Department, by default, due to the failure to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). The Board voted for the appellant, Mr. DaSilva, to be issued a temporary pistol permit.

Motion to adjourn: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried.
